       【章名】 第一節 管轄

       第一條 根據《中華人民共和國仲裁法》和有關法律的規定以及國務院的《決定》、《通知》及《批復》,制定本仲裁規則。

       第二條 中國海事仲裁委員會(原名中國國際貿易促進委員會海事仲裁委員會,以下簡稱仲裁委員會)以仲裁的方式,獨立、公正地解決產生于遠洋、沿海和與海相通的水域的運輸、生產和航行過程中的契約性或非契約性的海事爭議,以保護當事人的正當權益,促進國內外航運事業和經濟貿易的發展。仲裁委員會受理下列海事爭議案件:

       (一)關於船舶救助以及共同海損所產生的爭議;

       (二)關於船舶碰撞或者船舶損壞海上、通海水域、港口建築物和設施以及海底、水下設施所發生的爭議;

       (三)關於海/水上船舶經營、作業、租用、抵押、代理、拖帶、打撈、買賣、修理、建造、拆解業務以及根據運輸合同、提單、或者其他檔辦理的海/水上運輸業務和海/水上保險所發生的爭議;

       (四)關於海洋資源開發利用及海洋環境污染損害的爭議;

       (五)關於貨運代理合同、船舶物料供應合同、涉外船員勞務合同、漁業生產及捕撈合同所引起的爭議;

       (六)雙方當事人協議仲裁的其他海事爭議。

       第三條 仲裁委員會根據當事人在爭議發生之前或者在爭議發生之後達成的將爭議提交仲裁委員會仲裁的仲裁協議和一方當事人的書面申請,受理案件。仲裁協議系指當事人在合同中訂明的仲裁條款,或者以其他方式達成的提交仲裁的書面協定。

       第四條 仲裁委員會有權對仲裁協議的存在、效力以及仲裁案件的管轄權作出決定。當事人對仲裁協議的效力有異議的,如果一方請求仲裁委員會作出決定,另一方請求人民法院作出裁定,則由人民法院裁定。

       第五條 合同中的仲裁條款應視為與合同其他條款分離地、獨立地存在的條款,附屬于合同的仲裁協議也應視為與合同其他條款分離地、獨立地存在的一個部分;合同的變更、解除、終止、失效或無效以及存在與否,均不影響仲裁條款或仲裁協議的效力。

       第六條 對仲裁協議及/或仲裁案件管轄權的抗辯,應當在仲裁庭首次開庭前提出; 對書面審理的案件的管轄權的抗辯,應當在第一次實體答辯前提出。

       第七條 凡當事人同意將爭議提交仲裁委員會仲裁的,均視為同意按照本仲裁規則進行仲裁。

       第二節 組織

       第八條 仲裁委員會設名譽主任一人、顧問若干人。

       第九條 仲裁委員會由主任一人、副主任若干人和委員若干人組成。主任履行本規則賦予的職責,副主任受主任的委託可以履行主任的職責。仲裁委員會設秘書處,在仲裁委員會秘書長的領導下負責處理仲裁委員會的日常事務。

       第十條 仲裁委員會設立仲裁員名冊,仲裁員由仲裁委員會從對航海、海上運輸、對外貿易、保險和法律等方面具有專門知識和實際經驗的中外人士中聘任。

       第十一條 仲裁委員會設在北京。根據仲裁業務發展的需要,仲裁委員會可以在中國境內其他地方設立仲裁委員會分會。

     

        第二章 仲裁程式

     

       【章名】 第一節 仲裁申請、答辯、反請求

       第十二條 仲裁程式自仲裁委員會發出仲裁通知之日起開始。

       第十三條 申請人提出仲裁申請時應: (一)提交仲裁申請書,仲裁申請書應寫明:

       1. 申請人和被申請人的名稱和住所(如有郵遞區號、電話、電傳、傳真和電報號碼,也應寫明);

       2. 申請人所依據的仲裁協議;

       3. 案情和爭議要點;

       4. 申請人的請求及所依據的事實和證據。

       仲裁申請書應由申請人及/或申請人授權的代理人簽名及/或蓋章。 (二)在提交仲裁申請書時,附具申請人請求所依據的事實的證明文件。 (三)按照仲裁委員會制定的仲裁費用表的規定預繳仲裁費。

       第十四條 仲裁委員會秘書處收到申請人的仲裁申請書及其附件後,經過審查,認為申請仲裁的手續不完備的,可以要求申請人予以完備; 認為申請仲裁的手續已完備的,應立即向被申請人發出仲裁通知,並將申請人的仲裁申請書及其附件,連同仲裁委員會的仲裁規則、仲裁員名冊和仲裁費用表各一份,一併發送給被申請人,同時也將仲裁通知、仲裁規則、仲裁員名冊和仲裁費用表送交申請人。

       仲裁委員會向申請人和被申請人發出仲裁通知後,應指定一名秘書處的人員負責仲裁案件的程式管理工作。

       第十五條 申請人和被申請人應各自在收到仲裁通知之日起 20 天內在仲裁委員會仲裁員名冊中各自選定一名仲裁員,或者委託仲裁委員會主任指定。

       第十六條 被申請人應在收到仲裁通知之日起 45 天內向仲裁委員會秘書處提交答辯書和有關證明文件。

       第十七條 被申請人如有反請求,最遲應在收到仲裁通知之日起 60 天內以書面形式提交仲裁委員會。仲裁庭認為有正當理由的,可以適當延長此期限。

       被申請人提出反請求時,應在其書面反請求中寫明具體的反請求、反請求理由以及所依據的事實和證據,並附具有關的證明文件。

       被申請人提出反請求,應當按照仲裁委員會的仲裁費用表的規定預繳仲裁費。

       第十八條 申請人可以對其仲裁請求提出修改,被申請人也可以對其反請求提出修改; 但是,仲裁庭認為其修改的提出過遲而影響仲裁程式正常進行的,可以拒絕修改請求。

       第十九條 當事人提交仲裁申請書、答辯書、反請求書和有關證明材料以及其他文件時,應一式五份,如果當事人人數超過兩人,則應增加相應份數,如果仲裁庭組成人數為一人,則可以減少兩份。

       第二十條 被申請人未提交書面答辯及/或申請人對被申請人的反請求未提出書面答辯的,不影響仲裁程式的進行。

       第二十一條 當事人可以委託仲裁代理人辦理有關的仲裁事項; 接受委託的仲裁代理人,應向仲裁委員會提交授權委託書。

       中國公民和外國公民均可以接受委託,擔任仲裁代理人。

       第二十二條 當事人申請財產保全,仲裁委員會應當將當事人的申請提交被申請人住所地或其財產所在地的海事法院作出裁定。

       當事人申請證據保全,仲裁委員會應當將當事人的申請提交證據所在地的海事法院作出裁定。

       第二節 仲裁庭的組成

       第二十三條 雙方當事人應當各自在仲裁委員會仲裁員名冊中選定一名仲裁員或者委託仲裁委員會主任指定。第三名仲裁員由雙方當事人共同選定或者共同委託仲裁委員會主任指定。

       如果雙方當事人在被申請人收到仲裁通知之日起 20 天內未能共同選定或者共同委託仲裁委員會主任指定第三名仲裁員,則由仲裁委員會主任指定。第三名仲裁員擔任首席仲裁員。首席仲裁員與被選定或者被指定的兩名仲裁員組成仲裁庭,共同審理案件。

       第二十四條 雙方當事人可以在仲裁委員會仲裁員名冊中共同選定或者共同委託仲裁委員會主任指定一名仲裁員作為獨任仲裁員,成立仲裁庭,單獨審理案件。

       如果雙方當事人約定由一名獨任仲裁員審理案件,但在被申請人收到仲裁通知之日起 20 天內未能就獨任仲裁員的人選達成一致意見,則由仲裁委員會主任指定。

       第二十五條 申請人或者被申請人未按照本仲裁規則第十五條的規定選定或者委託仲裁委員會主任指定仲裁員的,則由仲裁委員會主任指定。

       第二十六條 仲裁案件有兩個或者兩個以上申請人及/或被申請人時,申請人之間及/或被申請人之間應當經過協商,在仲裁委員會仲裁員名冊中各自共同選定或者各自共同委託仲裁委員會主任指定一名仲裁員。

       如果申請人之間及/或被申請人之間未能在收到仲裁通知之日起 20 天內各自共同選定或者各自共同委託仲裁委員會主任指定一名仲裁員,則由仲裁委員會主任指定。

       第二十七條 被選定或者被指定的仲裁員,與案件有個人利害關係的,應當自行向仲裁委員會披露並請求回避。

       第二十八條 當事人對被選定或者被指定的仲裁員的公正性和獨立性產生具有正當理由的懷疑時,可以書面向仲裁委員會提出要求該仲裁員回避的請求,但應說明提出回避請求所依據的具體事實和理由,並舉證。

       對仲裁員的回避請求應在第一次開庭之前以書面形式提出; 如果要求回避事由的發生和得知是在第一次開庭審理之後,則可以在最後一次開庭終結之前提出。

       第二十九條 仲裁員是否回避,由仲裁委員會主任作出決定。

       第三十條 仲裁員因回避或者由於死亡、除名等其他原因不能履行職責時,應按照原選定或者指定該仲裁員的程式,選定或者指定替代的仲裁員。

       替代的仲裁員選定或者指定後,由仲裁庭決定以前進行過的全部或部分審理是否需要重新進行。

       【章名】 第三節 審理

       第三十一條 仲裁庭應當開庭審理案件。但經雙方當事人申請或者征得雙方當事人同意,仲裁庭也認為不必開庭審理的,仲裁庭可以只依據書面檔進行審理並作出裁決。

       第三十二條 仲裁案件第一次開庭審理的日期,經仲裁庭商仲裁委員會秘書處決定後,由秘書處於開庭前 30 天通知雙方當事人。當事人有正當理由的,可以請求延期,但必須在開庭前 12 天以書面形式向秘書處提出; 是否延期,由仲裁庭決定。

       第三十三條 第一次開庭審理以後的開庭審理的日期的通知,不受 30 天期限的限制。

       第三十四條 由仲裁委員會受理的案件應當在北京進行審理,經仲裁委員會秘書長同意,也可以在其他地點進行審理。

       第三十五條 仲裁庭開庭審理案件不公開進行,如果雙方當事人要求公開審理,由仲裁庭作出是否公開審理的決定。

       第三十六條 不公開審理的案件,雙方當事人及其仲裁代理人、證人、仲裁員、仲裁庭諮詢的專家和指定的鑒定人、仲裁委員會秘書處的有關人員,均不得對外界透露案件實體和程式進行的情況。

       第三十七條 當事人應當對其申請、答辯和反請求所依據的事實提出證據。仲裁庭認為必要時,可以自行調查事實,收集證據。

       仲裁庭自行調查事實,收集證據時,認為有必要通知雙方當事人到場的,應及時通知雙方當事人到場,經通知而一方或雙方當事人不到場的,仲裁庭自行調查事實和收集證據的行動不受其影響。

       第三十八條 仲裁庭可以就案件中的專門問題向專家諮詢或者指定鑒定人進行鑒定,專家和鑒定人可以是中國或外國的機構或公民。

       仲裁庭有權要求當事人,而且當事人也有義務向專家/鑒定人提供或出示任何有關資料、檔或財產、貨物,以供專家/鑒定人審閱、檢驗及/或鑒定。

       第三十九條 專家報告和鑒定報告的副本,應送給雙方當事人,給予雙方當事人對專家報告和鑒定報告提出意見的機會。任何一方當事人要求專家/鑒定人參加開庭的,經仲裁庭同意後,專家/鑒定人可以參加開庭,並在仲裁庭認為必要和適宜的情況下就他們的報告作出解釋。

       第四十條 當事人提出的證據由仲裁庭審定; 專家報告和鑒定報告,由仲裁庭決定是否採納。

       第四十一條 仲裁庭開庭審理時,一方當事人不出席,仲裁庭可以進行缺席審理和作出缺席裁決。

       第四十二條 開庭審理時,仲裁庭可以作庭審筆錄及/或錄音。仲裁庭認為必要時,可以作出庭審要點,並要求當事人及/其代理人、證人及/或其他有關人員在庭審要點上簽字或者蓋章。

       庭審筆錄和錄音只供仲裁庭查用。

       第四十三條 仲裁案件,如果當事人在仲裁庭之外自行達成和解,可以請求仲裁庭根據其和解協定的內容作出裁決書結案,也可以申請撤銷案件。在仲裁庭組成前申請撤銷案件的,由仲裁委員會秘書長作出決定;在仲裁庭組成後申請撤銷案件的, 由仲裁庭作出決定。

       當事人就已經撤銷的案件再提出仲裁申請時,由仲裁委員會主任作出受理或者不受理的決定。

       第四十四條 一方當事人知道或者理應知道本仲裁規則或仲裁協定中規定的任何條款或情事未被遵守,但仍參加仲裁程式或繼續進行仲裁程式而且不對此不遵守情況及時地明示地提出書面異議的,視為放棄其提出異議的權利。

       第四十五條 如果雙方當事人有調解願望,或一方當事人有調解願望並經仲裁庭征得另一方當事人同意的,仲裁庭可以在仲裁程式進行過程中對其審理的案件進行調解。

       第四十六條 仲裁庭可以按照其認為適當的方式進行調解。

       第四十七條 仲裁庭在進行調解的過程中,任何一方當事人提出終止調解或仲裁庭認為已無調解成功的可能時,應停止調解。

       第四十八條 在仲裁庭進行調解的過程中,雙方當事人在仲裁庭之外達成和解的, 應視為是在仲裁庭調解下達成的和解。

       第四十九條 經仲裁庭調解達成和解的,雙方當事人應簽訂書面和解協議;除非當事人另有約定,仲裁庭應當根據當事人書面和解協定的內容作出裁決書結案。

       第五十條 如果調解不成功,任何一方當事人均不得在其後的仲裁程式、司法程式和其他程式中援引對方當事人或仲裁庭在調解過程中發表過的、提出過的、建議過的、承認過的以及願意接近過的或否定過的任何陳述、意見、觀點或建議作為其請求、答辯及、或反請求的依據。

       【章名】 第四節 裁決

       第五十一條 仲裁庭應當在組庭之日起九個月內作出仲裁裁決書。在仲裁庭的要求下,仲裁委員會秘書長認為確有必要和確有正當理由的,可以延長該期限。

       第五十二條 仲裁庭應當根據事實,依照法律和合同規定,參考國際慣例,並遵循公平合理原則,獨立公正地作出裁決。

       第五十三條 由三名仲裁員組成的仲裁庭審理的案件,仲裁裁決依全體仲裁員或多數仲裁員的意見決定,少數仲裁員的意見可以作成記錄附卷。

       仲裁庭不能形成多數意見時,仲裁裁決依首席仲裁員的意見作出。

       第五十四條 仲裁庭在其作出的仲裁裁決中,應當寫明仲裁請求、爭議事實、裁決理由、裁決結果、仲裁費用和負擔、裁決的日期和地點。當事人協議不願寫明爭議事實和裁決理由的,以及按照雙方當事人和解協定的內容作出裁決的,可以不寫明爭議事實和裁決理由。

       第五十五條 除非仲裁裁決依首席仲裁員意見或獨任仲裁員意見作出,仲裁裁決應由多數仲裁員署名。持有不同意見的仲裁員可以在裁決書上署名,也可以不署名。

       仲裁員應在簽署裁決前將裁決書草案提交仲裁委員會。在不影響仲裁員獨立裁決的情況下,仲裁委員會可以就裁決書的形式問題提請仲裁員注意。

       裁決書應加蓋仲裁委員會印章。

       作出仲裁裁決書的日期,即為仲裁裁決發生法律效力的日期。

       第五十六條 仲裁庭認為必要或者當事人提出經仲裁庭同意時,可以在仲裁過程中在最終仲裁裁決作出之前的任何時候,就案件的任何問題作出中間裁決或部分裁決。任何一方當事人不履行中間裁決,不影響仲裁程式的繼續進行,也不影響仲裁庭作出最終裁決。

       第五十七條 仲裁庭有權在仲裁裁決書中裁定雙方當事人最終應向仲裁委員會支付的仲裁費和其他費用。

       第五十八條 仲裁庭有權在裁決書中裁定敗訴方應當補償勝訴方因為辦理案件所支出的部分合理的費用,但補償金額最多不得超過勝訴方勝訴金額的 10%。

       第五十九條 仲裁裁決是終局的,對雙方當事人均有約束力。任何一方當事人均不得向法院起訴,也不得向其他任何機構提出變更仲裁裁決的請求。

       第六十條 任何一方當事人均可以在收到仲裁裁決書之日起 30 天內就仲裁裁決書中的書寫、列印、計算上的錯誤或其他類似性質的錯誤,書面申請仲裁庭作出更正;如確有錯誤,仲裁庭應在收到書面申請之日起 30 天內作出書面更正,仲裁庭也可以在發出仲裁裁決書之日起 30 天內自行以書面形式作出更正。該書面更正構成裁決書的一部分。

       第六十一條 如果仲裁裁決有漏裁事項,任何一方當事人均可以在收到仲裁裁決書之日起 30 天內以書面形式請求仲裁庭就仲裁裁決中漏裁的仲裁事項作出補充裁決。

       如確有漏裁事項,仲裁庭應在收到上述書面申請之日起 30 天內作出補充裁決,仲裁庭也可以在發出仲裁裁決書之日起 30 天內自行作出補充裁決。補充裁決構成原裁決書的一部分。

       第六十二條 當事人應當依照仲裁裁決書寫明的期限自動履行裁決; 仲裁裁決書未寫明期限的,應當立即履行。

       一方當事人不履行的,另一方當事人可以根據中國法律的規定,向中國法院申請執行; 或者根據一九五八年《承認及執行外國仲裁裁決公約》或者中國締結或參加的其他國際條約,向外國有管轄權的法院申請執行。

     

       第三章 簡易程式

     

       第六十三條 除非當事人另有約定,凡是爭議金額不超過人民幣 50 萬元的,或爭議金額超過人民幣 50 萬元,經一方當事人書面申請並征得另一方當事人書面同意的,適用本簡易程式。

       第六十四條 申請人向仲裁委員會提出仲裁申請,經審查可以受理並適用簡易程式的,仲裁委員會秘書處應立即向雙方當事人發出仲裁通知。

       除非雙方當事人已從仲裁委員會仲裁員名冊中共同選定了一名獨任仲裁員,雙方當事人應在被申請人收到仲裁通知之日起 15 天內在仲裁委員會仲裁員名冊中共同選定或者共同委託仲裁委員會主任指定一名獨任仲裁員。雙方當事人逾期未能共同選定或者共同委託仲裁委員會主任指定的,仲裁委員會主任應立即指定一名獨任仲裁員成立仲裁庭審理案件。

       第六十五條 被申請人應在收到仲裁通知之日起 30 天內向仲裁委員會提交答辯書及有關證明文件; 如有反請求,也應在此期限內提出反請求書及有關證明文件。

       第六十六條 仲裁庭可以按照其認為適當的方式,審理案件; 可以決定只依據當事人提交的書面材料和證據進行書面審理,也可以決定開庭審理。

       第六十七條 當事人應按照仲裁庭的要求和限定的日期提交仲裁所需的書面材料及證據。

       第六十八條 對於開庭審理的案件,仲裁庭確定開庭的日期後,仲裁委員會秘書處應在開庭前 15 天將開庭日期通知雙方當事人。

       第六十九條 如果仲裁庭決定開庭審理,仲裁庭只開庭一次。確有必要的,仲裁庭可以決定再次開庭。

       第七十條 在進行簡易程式過程中,任何一方當事人沒有按照本簡易程式列事時, 不影響程式的進行和仲裁庭作出裁決的權力。

       第七十一條 仲裁請求的變更或反請求的提出,不影響簡易程式的繼續進行。

       第七十二條 開庭審理的案件,仲裁庭應在開庭審理或再次開庭審理之日起30天內作出仲裁裁決書;書面審理的案件,仲裁庭應當在仲裁庭成立之日起90天內作出仲裁裁決書。在仲裁庭的要求下,仲裁委員會秘書長認為確有必要和確有正當理由的,可以對上述期限予以延長。

       第七十三條本章未規定的事項,適用本仲裁規則的其他各章的有關規定。

     

       第四章 附則

     

       第七十四條 仲裁委員會以中文為正式語文。當事人另有約定的,則從其約定。仲裁庭開庭時,如果當事人或其代理人、證人需要語文翻譯,可以由仲裁委員會秘書處提供譯員,也可以由當事人自行提供譯員。

       對當事人提交的各種文書和證明材料,仲裁庭及/或仲裁委員會秘書處認為必要時,可以要求當事人提供相應的中文譯本或其他語文的譯本。

       第七十五條 有關仲裁的一切文書、通知、材料等均可以派人或以掛號信或航空特快專遞、傳真、電傳、電報或仲裁委員會秘書處認為適當的其他方式發送給當事人及/ 或其仲裁代理人。

       第七十六條 向當事人及/或其仲裁代理人發送的任何書面通訊,如經當面遞交收訊人或投遞至收訊人的營業地點、慣常住所或通訊位址,或者經合理查詢不能找到上述任一地點而以掛號信或能提供作過投遞企圖的記錄的其他任何手段投遞給收訊人最後一個為人所知的營業地點、慣常住所或通訊位址,即應視為已經送達。

       第七十七條 仲裁委員會除按照其制定的仲裁費用表向當事人收取仲裁費外,可以向當事人收取其他額外的、合理的實際開支,包括仲裁員辦理案件的特殊報酬、差旅費、食宿費以及仲裁庭聘請專家、鑒定人和翻譯等的費用。

       仲裁委員會對雙方當事人自行達成和解後申請撤銷的案件,可以視工作量的大小和實際開支的多少,收取仲裁費。

       第七十八條 仲裁協議或合同中的仲裁條款訂明由中國海事仲裁委員會仲裁或由其舊名稱的中國國際貿易促進委員會海事仲裁委員會仲裁的,均應視為雙方當事人一致同意由中國海事仲裁委員會仲裁。

       第七十九條 本仲裁規則自1995年10月1日起施行。在本仲裁規則施行前仲裁委員會受理的案件,仍適用受理案件時適用的仲裁規則; 雙方當事人同意的,也可以適用本仲裁規則。

       第八十條 本仲裁規則由仲裁委員會負責解釋。

       【章名】 Section 1 JurisdictionArticle 1

       These Rules are formulated in accordance with the Arbitration Law andthe provisions of the relevant laws of the People’s Republic of China(PRC) and pursuant to the "Decision ”, the "Notice" and "Official Reply"of the State Council of the PRC.Article 2

       China Maritime Arbitration Commission (formerly known as MaritimeArbitration Commission of the China Council for the Promotion ofInternational Trade, and hereinafter referred to as the "ArbitrationCommission")independently and impartially resolves, by means ofarbitration, contractual or non-contractual maritime disputes arisingfrom, or in the process of, transportation, production and navigation byor at sea, in coastal waters and other waters connected with sea, in orderto protect the legitimate rights and interests of the parties and promotethe development of the domestic and international shipping industry andeconomy and trade.

       The Arbitration Commission shall take cognizance of cases of followingmaritime disputes:

       (1) dispute arising from salvage and general average;

       (2) dispute arising from collision between vessels, or from damagecaused by a vessel to the structure and installation on the sea, waterwaysconnected with sea, in the harbour as well as the submarine or underwaterinstallation;

       (3) dispute arising from management, operation, chartering, mortgage,agency, towage, raising, sale, repair, building, demolition, ofsea-going/river vessel, as well as carriage by sea in virtue of contractsof affreightment, bill of lading or other documents, and marine insurance;

       (4) dispute regarding the utilization of the marine resources andpollution damages to the marine environment ;

       (5) dispute arising from contract of freight forwarding, supply ofship’s stores, employment of seaman aboard a foreign vessel, fisheryproduction and fishing;

       (6) other maritime dispute submitted for arbitration by agreementbetween the parties.Article 3

       The Arbitration Commission takes cognizance of cases in accordancewith an arbitration agreement between the parties concluded before orafter the occurrence of the dispute to refer their dispute to theArbitration Commission for arbitration and upon the written application byone of the parties.

       An arbitration agreement means an arbitration clause stipulated by theparties in their contract or a written agreement concluded by the partiesin other forms to submit their dispute for arbitration.Article 4

       The Arbitration Commission has the power to decide on the existenceand validity of an arbitration agreement and the jurisdiction over anarbitration case. If a party challenges the validity of the arbitrationagreement and requests the Arbitration Commission to make a decisionthereupon and he other party applies to the People’s Court for a ruling,the latter’s ruling shall prevail.Article 5

       An arbitration clause contained in a contract shall be regarded asexisting independently and separately from the other clauses of thecontract, and an arbitration agreement attached to a contract shall betreated as a part of the contract existing independently and separatelyfrom the other parts of the contract. The validity of an arbitrationclause or an arbitration agreement shall not be affected by themodification, rescission, termination, invalidity, revocation ornon-existence of the contract.Article 6

       Any objections to an arbitration agreement and/or jurisdiction over anarbitration case shall be raised before the first hearing conducted by thearbitration tribunal. Where a case is examined on the basis of documentsonly, the objections to jurisdiction should be raised before submission ofthe first substantive defense.Article 7

       Once the parties agree to submit their dispute to the ArbitrationCommission for arbitration, they shall be deemed that they have agreed toconduct the arbitration under these Rules.

       【章名】 Section 2 OrganizationArticle 8

       The Arbitration Commission shall have one honorary Chairman andseveral advisers.Article 9

       The Arbitration Commission is composed of one Chairman, severalVice-Chairmen and a number of Commission members. The Chairman performsthe functions and duties vested in him by these Rules and theVice-Chairmen may perform the Chairman’s functions and duties with theChairman’s authorization.

       The Arbitration Commission shall have a secretariat to handle itsday-to-day work under the leadership of the Secretary-General of theArbitration Commission.Article 10

       The Arbitration Commission shall maintain a Panel of Arbitrators. Thearbitrators shall be selected and appointed by the Arbitration Commissionfrom among Chinese and foreign personages with special knowledge andpractical experience in the fields of navigation, carriage by sea, foreigntrade, insurance and law and other fields.Article 11

       The Arbitration Commission is located in Beijing. The ArbitrationCommission may, according to the requirement of development of arbitrationbusiness, set up its Sub-Commissions in other places within china’sterritory.

       【章名】 Section 1 Application for Arbitration, Defense and Counter-claimArticle 12

       The arbitration proceedings shall commence from the date on which theNotice of Arbitration is sent out by the Arbitration Commission.Article 13

       The Claimant shall satisfy the following requirements when submittinghis Application for Arbitration:

       (1)an Application for Arbitration in writing shall be submitted andthe following shall be specified in the Application for Arbitration:

       (a)the name and address of the Claimant and those of the Respondent,including the zip code, telephone number, telex number, fax number andcable number, if any;

       (b)the arbitration agreement relied upon by the Claimant;

       (c)the facts of the case and the main points of dispute;

       (d)the Claimant’s claim and the facts and evidence on which his claimis based. The Application for Arbitration shall be signed and/or stampedby the Claimant and/or the attorney authorized by the Claimant.

       (2)When an Application for Arbitration is submitted to the ArbitrationCommission, the relevant documentary evidence on which the Claimant’sclaim is based shall accompany the Application for Arbitration.

       (3)The Claimant shall pay an arbitration fee in advance to theArbitration Commission according to the Arbitration Fee Schedule of theArbitration Commission.Article 14

       After receipt of the Application for Arbitration and its attachmentsand when the secretariat of the Arbitration Commission, after examination,deems that the Claimant has not completed the formalities required forarbitration, the secretariat shall demand the Claimant to complete them,and when the secretariat deems that the Claimant has completed theformalities, the secretariat shall immediately send to the Respondent aNotice of Arbitration together with one copy each of the Claimant’sApplication for Arbitration and its attachments as well as the ArbitrationRules, the Panel of Arbitrators and the Arbitration Fee Schedule of theArbitration Commission, and shall simultaneously send to the Claimant onecopy each of the Notice of Arbitration, the Arbitration Rules, the Panelof Arbitrators and Arbitration Fee Schedule. The secretariat of theArbitration Commission, after sending the Notice of Arbitration to theClaimant and Respondent, the Notice of Arbitration to the Claimant andRespondent, shall appoint one of its staff-members to take charge ofprocedural administration of the case.Article 15

       The Claimant and the Respondent shall, within 20 days as from the dateof receipt of the Notice of Arbitration, appoint an arbitrator from amongthe Panel of Arbitrators of the Arbitration Commission or authorize theChairman of the Arbitration Commission to make such appointment.Article 16

       The Respondent shall, within 45 days from the date of receipt of theNotice of Arbitration, submit his written defense and relevant documentaryevidence to the secretariat of the Arbitration Commission.Article 17

       The Respondent shall, at the latest within 60 days from the date ofreceipt of the Notice of Arbitration, lodge with the secretariat of theArbitration Commission his counterclaim in writing, if any. Thearbitration tribunal may extend that time limit if it deems that thereare justified reasons.

       When lodging a counterclaim, the Respondent must state in his writtenstatement of counterclaim his specific claim, reasons for his claim andfacts and evidence upon which his claim is based, and attach to hiswritten statement of counterclaim the relevant documentary evidence. Whenlodging a counterclaim, the Respondent shall pay an arbitration fee inadvance according to the Arbitration Fee Schedule of the ArbitrationCommission.Article 18

       The Claimant may request to amend his claim and the Respondent mayrequest to amend his counterclaim; but the arbitration tribunal may refusesuch a request for amendment if it considers that it is too late to raisethe request and the amendment may affect the arbitration proceedings.Article 19

       When submitting application for arbitration, written defense,statement of counterclaim, documentary evidence and other documents, theparty/parties shall submit them in quintuplicate. If the number of theparties exceeds two, additional copies shall be submitted accordingly; ifthe number of arbitrator of the arbitration tribunal is one, two copiesmay be reduced.Article 20

       The arbitration proceedings shall not be affected in case theRespondent fails to file his defense in writing or the Claimant fails tosubmit his written defense against the Respondent’s counterclaim.Article 21

       The parties may authorize arbitration agents to deal with the mattersrelating to arbitration; the authorized attorney must produce a Power ofAttorney to the Arbitration Commission.

       Chinese and foreign citizens can be authorized to act as arbitrationagents.Article 22

       When a party applies for property preservative measures, theArbitration Commission shall submit the party’s application for a rulingto the maritime court in the place where the domicile of the party againstwhom the property preservative measures are sought is located or in theplace where the property of the said party is located.

       When a party applies for taking interim measures of protection ofevidence, the Arbitration Commission shall submit the party’s applicationfor a ruling to the maritime court in the place where the evidence islocated.

       【章名】 Section 2 Formation of Arbitration TribunalArticle 23

       Each of the parties shall appoint one arbitrator from among the Panelof Arbitrators of the Arbitration Commission or entrust the Chairman ofthe Arbitration Commission to make such appointment. The third arbitratorshall be jointly appointed by the parties or appointed by the Chairman ofthe Arbitration Commission upon the parties’ joint authorization. In casethe parties fail to jointly appoint or jointly entrust the Chairman of theArbitration Commission to appoint the third arbitrator within 20 days fromthe date on which the Respondent receives the Notice of Arbitration, thethird arbitrator shall be appointed by the Chairman of the ArbitrationCommission. The third arbitrator shall act as the presiding arbitrator.

       The presiding arbitrator and the two appointed arbitrators shalljointly form an arbitration tribunal to jointly hear the case.Article 24

       Both parties may jointly appoint or jointly authorize the Chairman ofthe Arbitration Commission to appoint a sole arbitrator to form anarbitration tribunal to hear the case alone.

       If both parties have agreed on the appointment of a sole arbitrator tohear their case alone but have failed to agree on the choice of such asole arbitrator within 20 days from the date on which the Respondentreceives the Notice of Arbitration, the Chairman of the ArbitrationCommission shall make such an appointment.Article 25

       If the Claimant or the Respondent fails to appoint or authorize theChairman of the Arbitration Commission to appoint an arbitrator accordingto Article 15 of these Rules, the Chairman of the Arbitration Commissionshall appoint an arbitrator on his behalf.Article 26

       When there are two or more Claimants and/or Respondents in anarbitration case, the Claimants’ side and/or the Respondents’ side eachshall, through consultation, appoint or entrust the Chairman of theArbitration Commission to appoint one arbitrator from among the Panel ofArbitrators of the Arbitration Commission.

       If the Claimants’ side or the Respondents’ side fails to make suchappointment or entrustment within 20 days as from the date on which theRespondents’ side receives the Notice of Arbitration, the appointmentshall be made by the Chairman of the Arbitration Commission.Article 27

       Any appointed arbitrator having a personal interest in the case shallhimself disclose such circumstances to the Arbitration Commission andrequest a withdrawal from his office.Article 28

       A party may make a request in writing to the Arbitration Commissionfor the removal of an appointed arbitrator from his office, if the partyhas justified reasons to suspect the impartiality and independence of theappointed arbitrator. In the request, the facts and reasons on which therequest is based and evidence must be given.

       A challenge against an arbitrator for a removal from his office mustbe put forward in writing no later than the first oral hearing. If thegrounds for the challenge come out or are made known after the first oralhearing, the challenge may be raised after the first hearing but beforethe end of the last hearing.Article 29

       The Chairman of the Arbitration Commission shall decide on thechallenge.Article 30

       If an arbitrator cannot perform his duty owing to withdrawal, demise,removal or other reasons, a substitute arbitrator shall be appointed inaccordance with the procedure pursuant to which the original arbitratorwas appointed.

       After the appointment of the substitute arbitrator, the arbitrationtribunal has discretion to decide whether or not the whole or part of theprevious hearings shall be repeated. Section 3 HearingArticle 31

       The arbitration Tribunal shall hold oral hearings when examining acase. At the request of the parties or with their consent, oral hearingsmay be omitted if the arbitration tribunal also deems that oral hearingsare unnecessary, and then the arbitration tribunal may examine the caseand make an award on the basis of documents only.Article 32

       The date of the first oral hearing shall be fixed by the arbitrationtribunal in consultation with the secretariat of the ArbitrationCommission.

       The notice of the date of the hearing shall be communicated by thesecretariat of the Arbitration Commission to the parties 30 days beforethe date of the hearing. A party having justified reasons may request apostponement of the date of the hearing. His request must be communicatedto the secretariat of the Arbitration Commission 12 days before the dateof the hearing and the arbitration tribunal shall decide whether topostpone the hearing or not.Article 33

       The notice of the date of hearing subsequent to the first hearing isnot subject to the 30-day time limit.Article 34

       The cases taken cognizance of by the Arbitration Commission shall beheard in Beijing, or in other places with the approval of theSecretary-General of the Arbitration Commission.Article 35

       The arbitration tribunal shall not hear cases in open session. If bothparties request a hearing to be held in open session, the arbitrationtribunal shall decide whether to hold the hearing in open session or not.Article 36

       When a case is heard in closed session, the parties, their attorneys,witnesses, arbitrators, experts consulted by the arbitration tribunal andappraisers appointed by the arbitration tribunal and the relevantstaff-members of the secretariat of the Arbitration Commission shall notdisclose to outsiders the substantive or procedural matters of the case.Article 37

       The parties shall produce evidence for the facts on which their claim,defense and counterclaims are based. The arbitration tribunal mayundertake investigations and collect evidence on its own initiative, if itdeems it necessary.

       If the arbitration tribunal investigates and collects evidence on itsown initiative, it shall timely inform the parties to be present on thespot if it deems it necessary. Should one party or both parties fail toappear on the spot, the investigation and collection of evidence shall byno means be affected.Article 38

       The arbitration tribunal may consult an expert or appoint an appraiserfor the clarification of special questions relating to the case. Such anexpert or appraiser can be an organization or a citizen, Chinese orforeign.

       The arbitration tribunal has the power to order the parties and theparties are also obliged to submit or produce to the expert or appraiserany materials, documents, properties or goods related to the case forcheck-up, inspection and/or appraisal.Article 39

       The expert’s report and the appraiser’s report shall be copied to theparties so that they may have the opportunity to give their opinionsthereon. At the request of any party to the case and with the approval ofthe arbitration tribunal, the expert and appraiser may be present at thehearing and give explanations of their reports when the arbitrationtribunal deems it necessary and appropriate.Article 40

       The evidence submitted by the parties shall be examined and decided bythe arbitration tribunal. The adoption of the expert’s report and theappraiser’s report shall be determined by the arbitration tribunal.Article 41

       Should one of the parties fail to appear at the hearing, thearbitration tribunal may proceed with the hearing and make an award bydefault.Article 42

       During the hearing, the arbitration tribunal may make a record inwriting and/or by tape-recording. The arbitration tribunal may, when itdeems it necessary, make a minute stating the main points of the hearingand ask the parties and/or their attorneys, witnesses and/or other personsinvolved to sign their names on it and/or affix their seals to it.

       The record in writing or by tape-recording is only for the use andreference of the arbitration tribunal.Article 43

       If the parties to an arbitration case reach an amicable settlementagreement by themselves, they may either request the arbitration tribunalto make an award in accordance with the contents of their amicablesettlement agreement to end the case or request a dismissal of the case.The Secretary-General of the Arbitration Commission shall decide on therequest for a dismissal of the case if the request is made before theformation of the arbitration tribunal, and the arbitration tribunal shalldecide if the request is put forward after the formation of thearbitration tribunal.

       If the party or the parties refer the dismissed case again to theArbitration Commission for arbitration, the Chairman of the ArbitrationCommission shall decide whether to accept the reference or not.Article 44

       A party who knows or should have known that any provision orrequirement of these Rules has not been complied with and yet proceedswith the arbitration proceedings without explicitly raising in writing hisobjection to non-compliance in a timely manner shall be deemed to havewaived his right to object.Article 45

       If both parties have a desire for conciliation or one party so desiresand the other party agrees to it when consulted by the arbitrationtribunal, the arbitration tribunal may conciliate the case under itscognizance in the process of arbitration.Article 46

       The arbitration tribunal may conciliate cases in the manner it deemsappropriate.Article 47

       The arbitration tribunal shall terminate conciliation and continue thearbitration proceedings when one of the parties requests a termination ofconciliation or when the arbitration tribunal believes that furtherefforts to conciliate will be futile.Article 48

       If the parties have reached an amicable settlement outside thearbitration tribunal in the course of conciliation conducted by thearbitration tribunal, such settlement shall be deemed as one which hasbeen reached through the arbitration tribunal’s conciliation.Article 49

       The parties shall sign a settlement agreement in writing when anamicable settlement is reached through conciliation conducted by thearbitration tribunal, and the arbitration tribunal shall end the case bymaking an arbitration award in accordance with the contents of thesettlement agreement unless otherwise agreed by the parties.Article 50

       Should conciliation fail, any statement, opinion, view or proposalwhich has been made, raised, put forward, acknowledged, accepted orrejected by either party or by the arbitration tribunal in the process ofconciliation shall not be invoked as grounds for any claim, defenseand/or counterclaim in the subsequent arbitration proceedings, judicialproceedings or any other proceedings.

       【章名】 Section 4 AwardArticle 51

       The arbitration tribunal shall render an arbitral award within 9months as from the date on which the arbitration tribunal is formed. TheSecretary General of the Arbitration Commission may extend this time limitat the request of the arbitration tribunal if the Secretary-General of thearbitration Commission considers that it is really necessary and thereasons for extension are truly justified.Article 52

       The arbitration tribunal shall independently and impartially make itsarbitral award on the basis of the facts, in accordance with the law andthe terms of the contracts, with reference to international practices andin compliance with the principle of fairness and reasonableness.Article 53

       Where a case is heard by an arbitration tribunal composed of threearbitrators, the arbitral award shall be decided by the majority of thearbitrators and the minority opinion may be written in the record anddocketed into the file.

       When the arbitration tribunal cannot attain a majority opinion, thearbitral award shall be decided in accordance with the presidingarbitrator’s opinion.Article 54

       The arbitration tribunal shall state in the arbitral award the claims,the facts of the dispute, the reasons on which the arbitral award isbased, the result of the arbitral award, the allocation of the arbitrationcosts, the date on which and the place at which the arbitral award ismade. The facts of the dispute and the reasons on which the arbitral awardis based may not be stated in the arbitral award if the parties haveagreed not to state them in the arbitral award, or the arbitral award ismade in accordance with the contents of the settlement agreement reachedbetween the parties.Article 55

       Unless the arbitral award is made in accordance with the opinion ofthe presiding arbitrator or the sole arbitrator, the arbitral award shallbe signed by all the arbitrators or the majority arbitrators sitting onthe arbitration tribunal. An arbitrator who has a dissenting opinion maysign or not sign his name on the arbitral award.

       The arbitrators shall submit their draft arbitral award to theArbitration Commission before signing the award. The ArbitrationCommission may remind the arbitrator of any issue related to the form ofthe arbitral award on condition that the arbitrator’s independence ofdecision is not affected.

       The Arbitration Commission’s stamp shall be affixed to the arbitralaward. The date on which the arbitral award is made is the date on whichthe arbitral award comes into legal effect.Article 56

       The arbitration tribunal may, if it deems it necessary or the partiesso request and the arbitration tribunal agrees, make an interlocutoryaward or partial award on any issue of the case at any time in the courseof arbitration before the final award is made. Either party’s failure toperform the interlocutory award does not affect the continuation of thearbitration proceedings and the making of the final award by thearbitration tribunal.Article 57

       The arbitration tribunal has the power to determine in the arbitralaward the arbitration fee and other expenses to be eventually paid by theparty or the parties to the Arbitration Commission.Article 58

       The arbitration tribunal has the power to decide in the arbitral awardthat the losing party shall pay the winning party as compensation aproportion of the expenses reasonably incurred by the winning party indealing with the case. The amount of such compensation shall not in anycase exceed 10% of the total amount awarded to the winning party.Article 59

       The arbitral award is final and binding upon both disputing parties.Neither party may bring a suit before a law court or make a request to anyother organization for revising the arbitral award.Article 60

       Either party may request in writing that a correction be made to thewriting, typing, calculating and similar errors contained in the arbitralaward within 30 days from the date of receipt of the arbitral award; ifthere is really an error in the arbitral award, the arbitration tribunalshall make a correction in writing within 30 days form the date on receiptof the written request for correction, and the arbitration tribunal may byitself make a correction in writing within 30 days from the date on whichthe arbitral award is issued. The correction in writing forms a part ofthe arbitral award.Article 61

       If anything that should be awarded has been omitted in the arbitralaward, either of the parties may make a request in writing to thearbitration tribunal for an additional award within 30 days from the dateon which the arbitral award is received.

       If something which should be awarded is really omitted, thearbitration tribunal shall make an additional award within 30 days fromthe date of receipt of the request in writing for an additional award. Thearbitration tribunal may by itself make an additional award within 30 daysfrom the date on which the arbitral award is issued. The additional awardforms a part of the arbitral award which has been previously issued.Article 62

       The parties must automatically execute the arbitral award within thetime limit specified in the arbitral award. If no time limit is specifiedin the arbitral award, the parties shall carry out the arbitral awardimmediately.

       In case one party fails to execute the arbitral award, the other partymay apply to the Chinese court for enforcement of the arbitral awardpursuant to Chinese law or apply to the competent foreign court forenforcement of the arbitral award according to the 1958 Convention onRecognition and Enforcement of Foreign Arbitral Awards or otherinternational treaties that China has concluded or participated in.

       【章名】 Chapter III Summary ProcedureArticle 63

       Unless otherwise agreed by the parties, this Summary Procedure shallapply to any case in dispute where the amount of the claim totals not morethan RMB 500, 000 yuan, and to any case in dispute where the amount of theclaim totals more than RMB 500, 000 yuan provided that one party appliesfor arbitration under this Summary Procedure and the other party agrees inwriting.Article 64

       When an application for arbitration is submitted to the ArbitrationCommission by one of the parties and the application is accepted by theArbitration Commission after examination and the Summary Procedure isapplicable, the secretariat of the Arbitration Commission shallimmediately serve a notice of Arbitration to each of the parties. Unlessboth parties have jointly appointed one sole arbitrator from among thePanel of Arbitrators of the Arbitration Commission, they shall jointlyappoint or jointly entrust the Chairman of the Arbitration Commission toappoint one sole arbitrator within 15 days from the date on which theNotice of Arbitration is received by the Respondent. Should the partiesfail to make such appointment or entrustment, the Chairman of theArbitration Commission shall immediately appoint one sole arbitrator toform an arbitration tribunal to hear the case.Article 65

       The Respondent shall, within 30 days from the date of receipt of theNotice of Arbitration, submit his defense and relevant documentaryevidence to the secretariat of the Arbitration Commission; a counterclaim,if any, shall be lodged together with documentary evidence within the saidtime limit.Article 66

       The arbitration tribunal may hear the case in the way it deemsappropriate. The arbitration tribunal has discretion to hear the case onlyon the basis of the written materials and evidence submitted by theparties or to hold an oral hearing as well.Article 67

       The parties must hand in written materials and evidence needed for thearbitration in compliance with the requirements of the arbitrationtribunal within the time limit given by the arbitration tribunal.Article 68

       For a case which needs an oral hearing, the secretariat of theArbitration Commission shall, after the arbitration tribunal has fixed adate for hearing, inform the parties of the date of the hearing 15 daysbefore the date of the hearing.Article 69

       If the arbitration tribunal decides to hear the case orally, only oneoral hearing shall be held. However, the arbitration tribunal may hold twooral hearings if really necessary.Article 70

       Should one of the parties fail to act in compliance with this SummaryProcedure during summary proceedings, such failure shall not affect thearbitration tribunal’s conduct of the proceedings and the arbitrationtribunal’s power to render an arbitral award.Article 71

       The conduct of the proceedings shall not be affected by any amendmentof the claim or by the lodging of a counterclaim.Article 72

       Where a case is heard orally, the arbitration tribunal shall make anarbitral award within 30 days from the date of the oral hearing if onehearing is to be held, or from the date of the second oral hearing if twooral hearings are to be held. Where a case is examined on the basis ofdocuments only, the arbitration tribunal shall render an arbitral awardwithin 90 days from the date on which the arbitration tribunal is formed.The Secretary-General of the Arbitration Commission may extend the saidtime limit if such extension is necessary and justifiable.Article 73

       For matters not covered in this Chapter, the relevant provisions inthe other Chapters of these Rules shall apply.

       【章名】 Chapter IV Supplementary ProvisionsArticle 74

       The Chinese language is the official language of the ArbitrationCommission. If the parties have agreed otherwise, their agreement shallprevail. At the hearing, if the parties or their attorneys or witnessesrequire language interpretation, the secretariat of the ArbitrationCommission may provide an interpreter for them or the parties may bringwith them their own interpreter.

       The arbitration tribunal and/or the secretariat of the ArbitrationCommission may, if it deems it necessary, request the parties to hand incorresponding translation copies in Chinese language or other languages ofthe documents and evidential materials submitted by the parties.Article 75

       All the arbitration documents, notices and materials may be sent tothe parties and/or their attorneys in person, or by registered letter orexpress airmail, telefax, telex, cable or by any other means which aredeemed proper by the secretariat of the Arbitration Commission.Article 76

       Any written communication to the parties is deemed to have beenproperly served if it is delivered to the addressee or delivered at hisplace of business, habitual residence or mailing address; or if none ofthese can be found after making a reasonable inquiry, a writtencommunication is deemed to have been served if it is sent to theaddressee’s last known place of business, habitual residence or mailingaddress by registered letter or by any other means which provides a recordof the attempt to deliver it.Article 77

       Apart form charging arbitration fees from the parties according to thearbitration Fee Schedule of the Arbitration Commission, the ArbitrationCommission may collect from the parties other extra, reasonable and actualexpenses including arbitrators’ special remuneration and their travel andboarding expenses for dealing with the case and the fees and expenses forexperts, appraisers and interpreters appointed by the arbitrationtribunal, etc.

       If a case is withdrawn after the parties have reached betweenthemselves an amicable settlement, the Arbitration Commission may charge acertain amount of fees from the parties in consideration of the quantityof work and the amount of the actual expenses incurred by the ArbitrationCommission.Article 78

       Where an arbitration agreement or an arbitration clause contained inthe contract provides for arbitration to be conducted by China MaritimeArbitration Commission or by its former named Maritime ArbitrationCommission of the China Council for the Promotion of International Trade,the parties shall be deemed to have unanimously agreed that thearbitration shall be conducted by China Maritime Arbitration Commission .Article 79

       These Rules shall come into force as from October 1, 1995. For caseswhich have been taken cognizance of by the Arbitration Commission beforethe date on which these Rules become effective, the Rules of Arbitrationeffective on the date when the cases were taken cognizance of shall apply.However, these Rules shall be applied if the parties so agree.Article 80
